riceworks® Recipeworks
NO PURCHASE NECESSARY TO ENTER OR WIN
1. How it works
The Contest starts July 1, 2010 at 8:00:00 a.m. ET and ends September 30, 2010 at 11:59:00 ("Contest Period"), and is divided into three phases:
(1) Competition Phase – starts July 1, 2010 at 8:00:00 a.m. ET and ends October 1, 2010 at 11:59:00 p.m. ET ("Competition Period"). During the Competition Period entrants may register and submit an original recipe containing riceworks® crisps (“Entry” and collectively “Entries”). Taste, originality, difficulty and presentation will determine the winner and are the elements to be collectively referred to herein as the "Judging Criteria".
(2) Judging Phase – starts October 2, 2010at 9:00 a.m. ET and ends October 25, 2010 at 5:00 p.m. ET ("Judging Period"). During the Judging Period the Entries that meet the eligibility criteria set forth below ("Eligible Entries") will be evaluated based on the Judging Criteria. Eligible Entries will be judged, resulting in a selection of fifty 50 Finalist Nominations.
2. Eligible Entries
Eligible Entries must be submitted by a registered user of the riceworks® recipe works website www.riceworksrecipeworks.com (an “Entrant”), must be submitted electronically as permitted by that site and must be received during the Competition Period. Entrants must satisfy all of the below criteria or their Entry will not advance to the Judging Phase. There are no restrictions on the number of original Entries permitted but no Entry may be submitted more than once.
3. Who can enter
Legal residents of Canada (except residents of Quebec), the 50 United States or the District of Columbia, who have reached the age of majority in their Province, State District of residence as of the date of entry, have a valid email address and include all requested contact information can register to enter Excluded from eligibility are employees of Sponsor or members of their immediate family (spouse/domestic partner, parent, sibling, or child). CONTEST VOID IN PUERTO RICO, QUEBEC AND WHERE PROHIBITED BY LAW.
4. How to register and enter
NO PURCHASE NECESSARY. Internet access required. To register, go to http://www.riceworksrecipeworks.com and complete the registration form at any time during the Contest Period. You will be asked to provide your name and email address. All fields must be completed unless indicated as optional. You only need to register once. Each entrant must register him or herself. Limit: One (1) Account per person. By registering, you are acknowledging your acceptance of, and agreement to be bound by, these Contest Rules and you may then submit an Entry as permitted by www.riceworksrecipeworks.com.
5. Disqualification of Entry
Sponsor reserves the right, in our sole discretion, at any time to disqualify any Entry or Entrant that does not comply with the requirements set forth in these Contest Rules, if entrant is not in full compliance with these Contest Rules, or if it determines that it would be necessary or appropriate to disqualify any Entry or Entrant to avoid potential liability to Sponsor, to maintain the integrity of the Contest, or to protect the welfare of Sponsor, the Contest or the Contest participants.
6. Judging
All Eligible Entries will be initially evaluated by a panel of judges [Tricia Ryan, John Frostad, Shelley Case]. Judging will be based on the four Judging Criteria as follows: (i) Taste, 30%; (ii) Originality, 30%; (iii) Difficulty 20%; and (iv) Presentation, 20%. The fifty top-scoring Entries based on the evaluation by the Judges, and that also comply with these Contest Rules, will be publicly announced as the Finalist Entries on or about November 6, 2010.. In the event of a tie in either round of judging, the Entry with the highest score in Taste will win. Sponsor will email each of the finalist Entries shortly before the public announcement. Odds of winning depend on number and quality of eligible nominations received. All judging will take place at the Shearers’ Foods Canada, Inc. offices located at 1030 West Georgia #1900 Vancouver, BC.
7. Voting
The final decision for the prize winners will be decided on by the three judges, based on the Judging Criteria.
8. Winner Selection and Notification
We will contact the potential winning Entrants on or about October 25, 2010 by at the e-mail address provided at registration. The winning Entries will be announced on the riceworks recipeworks and riceworks® websites on or about November 6, 2010, once all other requirements of these Contest Rules have been complied with.
9. Prizes
The winning Entries will be published in a custom made cookbook, to be released on or about November 15, 2010. Proceeds from sales of the cookbook will go to charity. Each winner will also receive a copy of the riceworks® Recipeworks cookbook.
Before being declared a winner the author of the selected Entry will be required to execute and return an Affidavit of Eligibility/Release of Liability/Prize Acceptance Form within seven (7) days following notification. Return of any prize notification as undeliverable or failure of any Entrant to return the Affidavit of Eligibility/Release of Liability/Prize Acceptance Form within the time required or failure of any Entrant to comply with any official rules will result in disqualification and selection of an alternate winner.
By participating in the Contest, you warrant that your Entry is original and does not infringe on the intellectual property rights of any third party. You must also obtain the permission of all people appearing in your Entry, and will provide Sponsor with release forms from these people if requested. You agree to indemnify Shearer’s Foods Canada, Inc. for any claim, demand, judgment, or other allegation arising from any accused or actual violation of anyone’s intellectual property or other legally protected interest in your Entry. By submitting an Entry, you agree that ownership of the Entry and all intellectual property rights in the Entry are assigned to Sponsor, you waive all moral rights in such intellectual property, and agree to sign any further documentation required by Sponsor to give effect to this clause. You also understand and agree that your entry may be posted on the Contest website or other promotional material for Sponsor without any compensation to you, and that you have no expectation of privacy in any Entry.
Winners grant Sponsor the right to use and publish their legal name and state or province of residence online and in print, or any other media, in connection with the Contest. Except winners who are residents of the state of Tennessee, acceptance of a prize constitutes permission for Sponsor and its advertising and promotional agencies to use winners’ names and likenesses for editorials, advertising, and promotional purposes without payment of additional compensation unless prohibited by law. By entering, you release and hold harmless Sponsor, its respective parents, subsidiaries, affiliates, directors, officers, employees, attorneys, agents and representatives from any and all liability for any injuries, loss, claim, action, demand or damage of any kind arising from or in connection with the Contest or any prize won, any misuse or malfunction of any prize awarded, any delay in receiving any prize awarded, participation in any Contest-related activity, or participation in the Contest.
10. General Terms and Conditions
As a condition of participating in this Contest, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Contest shall be resolved individually, without resort to any form of class action, exclusively, before a court of competent jurisdiction located in Vancouver, B.C. which court shall apply the laws of the state of B.C. without regard for rules of conflicts of law. In any such dispute, participant shall, under no circumstances, be entitled to claim punitive, incidental, or consequential damages, or any other damages, including attorneys’ fees, other than participant’s actual out-of-pocket expenses (if any) associated with participating in the Contest, and participant hereby waives all rights to have damages multiplied or increased.
You agree that the decisions of Sponsor with respect to any and all aspects of Contest shall be final, including eligibility, judging and prize fulfillment. You are not entitled to be present for the judging.
Sponsor is not responsible for: (a) lost, late, unintelligible, incomplete, damaged, or garbled recipes or votes; (b) telephone, computer, hardware, software, programming or network failure or malfunction, or interrupted or unavailable network, server or other connections, or other technical failure or error, or failure to properly process Entries or votes; (c) communication disruption or other forces beyond the reasonable control of Sponsors, including without limitation inability to access the Contest website, use the Message Boards, register, submit or endorse Entries, or vote; (d) any disruption related to Internet traffic, virus, bug, or unauthorized intervention; (e) damage caused by computer virus or otherwise to any computer from users' access to or use of the Contest website, whether human, mechanical, or electronic; or (f) incorrect or inaccurate information, or other error of any kind, whether caused by Sponsor, participants, users, or by any of the programming or equipment associated with or used in Contest.
If such malfunction, error, disruption, or damage occurs, and/or impairs the administration, security, fairness, integrity, or proper execution of the Contest, and/or the Contest is otherwise not capable of running as planned, Sponsor may, in its sole discretion, suspend the Contest for the remainder of the Contest Period or terminate the Contest by posting a notice on www.howriceworksbetter.com. Sponsor reserves the right in its sole discretion to disqualify the Entry associated with any person found tampering with or abusing any aspect of the Contest. Additionally, Sponsor reserves the right in its sole discretion to suspend or terminate any user's access to the Contest website or participation in the Contest if Sponsor believes such person to be causing any such malfunction, error, disruption, or damage, or such user is suspected of engaging in any unlawful or fraudulent conduct, and invalidate any endorsements provided or vote cast by such user.
Your access to and use of the Contest website and participation in the Contest is subject to all applicable international, federal, provincial, state, and local laws and regulations. You agree that your participation in the Contest is voluntary, personal, and non-transferable. Sponsor may, in its sole discretion, immediately terminate your access to the Contest website should your conduct fail to conform to these Contest Rules.
The Contest website may provide a link to other websites by allowing you to leave the Contest website to access third-party material or by bringing the third-party material into the Contest site via "inverse" hyperlinks and framing technology (a "linked site"). Sponsor has no discretion to alter, update, or control the content on a linked site. The fact that Sponsor has provided a link to a site is not an endorsement, authorization, sponsorship, or affiliation with respect to such site, its owners, or its providers. There are inherent risks in relying upon using, or retrieving any information found on the Internet; Sponsor urges you to make sure you understand these risks before relying upon, using, or retrieving any such information on a linked site.
Sponsor permits users to add certain hypertext links to the Contest site. Sponsor, however, reserves the right to disable and remove any such links and specifically disclaims any responsibility for the content available on any other internet sites linked to the Contest website. Sponsor prohibits the framing of any content available through the Contest website. Access to any other Internet sites linked to the Contest website is at the user's own risk. You should be aware that linked sites may contain rules and regulations, privacy provisions, confidentiality provisions, transmission of personal data provisions, and other provisions that differ from the provisions provided on the Contest website. Sponsor is not responsible for such provisions and expressly disclaim any and all liability related to such provisions.
All content on the Contest website, or obtained from a linked site, are provided to you "as is" without warranty of any kind, either express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose, title, non-infringement, security, or accuracy. Sponsor does not endorse and are not responsible for: (a) the accuracy or reliability of any opinion, advice, or statement made by users or anyone else on or through the Contest website, as they may be contained in the entries or otherwise; (b) any content provided on the Contest website and any linked sites; or (c) the capabilities or reliability of any product or service obtained from the Contest website or a linked site. Other than as required under applicable consumer protection laws, under no circumstance will Sponsor be liable for any loss or damage caused by your reliance on information obtained through the Contest website or a linked site, or your reliance on any product or service obtained from the Contest website or a linked site. It is your responsibility to evaluate the accuracy, completeness, or usefulness of any opinion, advice, or other content available through the Contest website or obtained from a linked site.
Please seek the advice of professionals, as appropriate, regarding the evaluation of any specific opinion, advice, product, service, or other content. Sponsor may change the content on the Contest website at any time without notice. Sponsor may make improvements or changes to the Contest website at any time. You agree that Sponsor and any of its respective officers, directors, employees, or agents will not be liable, whether in contract, tort, strict liability, or otherwise, for any indirect, punitive, special, consequential, incidental, or indirect damages (including without limitation lost profits, cost of procuring substitute service, or lost opportunity) arising out of or in connection with Contest, the use of the Contest website or a linked site, or with the delay or inability to use the Contest website or a linked site, even if Shearer’s Foods Canada, Inc. is made aware of the possibility of such damages. Sponsor cannot and does not guarantee continuous, uninterrupted, or secure access to the Contest website.By submitting a recipe:
- You warrant that the recipe is original and is not copied from any other source, and agree to indemnify Shearer’s Foods Canada, Inc. (“Shearer’s”) for any claim, demand, judgment, or other allegation arising from any accused or actual violation of anyone’s copyright or other legally protected interest in your submission.
- You agree that ownership of the recipe and any copyright in the recipe are assigned to Shearer’s, and agree to sign any further documentation required by Shearer’s to give effect to this clause.
- You grant Shearer’s the right to edit, modify, format, or adapt your recipe at Shearer’s sole discretion.
- You grant Shearer’s the right to use and publish your legal name and state or province of residence online and in print, or any other media, in connection with the recipe.
- You release and hold harmless Shearer’s, its respective parents, subsidiaries, affiliates, directors, officers, employees, attorneys, agents, and representatives from any and all liability for any injuries, loss, claim, action, demand or damage of any kind arising from or in connection with the use and publication of the recipe or any identifying information you submit along with the recipe.
